Nathan Spicer was sentenced to complete a three-year probation order, subject to conditions, for the offence, which he committed on 25 August.

The prosecution's case was based on admissions Spicer, a father-of-one, had made in police interviews.

Judge Russell Finch said the matter would not have gone before the court if it was not for what he had told officers.

Although the custody threshold had been passed, the court had decided not to send him to youth detention because of the unusual circumstances of the case.

But it could not, he warned, be used to set a precedent for other cases.

'You do anything else wrong and you will be back and it will be straight back inside,' Judge Finch told Spicer.
