Ian and Catherine Birnie are also planning a separate defamation case against former Public Services minister Paul Luxon, who is now at the helm of HSSD, over alleged comments made on social media.

Mr Birnie, pictured, who is planning a further claim in the UK for medical problems, said he planned to bring the case for defamation against the jurats for comments made about him in the judgment.

Details of the fresh cases came as the couple launched their appeal against the level of award they received, which was £66,924.

In a separate matter, the couple have been told they must pay 40% of the the States' costs for the damages case.

Mr and Mrs Birnie live at Rue de l'Eglise, Forest, opposite what was formerly the southern works compound. They had been claiming £523,774 for problems they said they had to bear with light pollution, vibration, smell, dust and noise.
