Bridge marina bill goes up by £1.5m.

COSTS totalling around £1.5m. have been incurred by the States in a long-running legal battle with the St Sampson's Marina contractor.

The settlement was made by the former Public Services board in April this year, the same month a highly critical independent review was released into the ill-fated Pfos court action, which in the end cost nearly £8m.

In the St Sampson's marina case the States agreed to pay £800,000 in 'full and final' settlement of the claim from contractor Miller & Baird, which had been demanding more than £3.1m.

The Public Services board agreed to the settlement, rather than go to arbitration, on the back of legal advice and a financial risk assessment.

Details of the case emerged within the States' Trading Supervisory Board ports accounts, as part of an appendix to the newly-released States Accounts 2015, and it has since been confirmed that the overall cost of the case stands at about £1.5m. – on top of the £3.56m. paid to Miller & Baird under the original contract for the 2003/04 project.

The new States Trading Supervisory Board, which took over responsibility of the ports from PSD, said that if the company's claim had been successful, the States could have been liable for between £4m. and £6m.
