POOR performance at work may not be the fault of the employee, businesses were warned at an employment seminar.

Lawyers from Carey Olsen were advising on the best procedures for managing capability issues in the workplace.

Advocate Elaine Gray and senior associate Rachel Richardson outlined the key issues surrounding capability, performance and absence due to illness.

'Performance issues can arise due to insufficient training, poor work systems, a lack of appropriate equipment or illhealth,' said Ms Richardson.

'It is therefore important for employers to conduct full investigations into the reasons behind any lack of capability before formal action is taken so that the employer can then take steps to address any such issues.'
