Signature celebration ideal as image right

GARETH BALE'S now-famous heart-shaped goal celebration could be an ideal candidate for registration as an image right in Guernsey, a sports law expert has said.

GARETH BALE'S now-famous heart-shaped goal celebration could be an ideal candidate for registration as an image right in Guernsey, a sports law expert has said.

Patrick Conliffe, an Irish solicitor who manages a number of Irish football clients at McHale Muldoon in Dublin, wrote positively about the island's image rights law in The Irish Times.

He said that Bale's signature celebration, which is currently subject to a trademark application in England and the EU, could be registered as an image right without the evidential requirements of a trademark application.

The footballer, or the holder of the image right, could then sell and license the right as a legal commodity.

Mr Conliffe, who is also a registered lawyer with the FA, said the move would add 'value, protection and clarity' to the image.
