Judge rules that 'scam' binmen must face full trial

ATTEMPTS to get a court case against four dismissed binmen thrown out have failed, after the judge ruled that the evidence so far showed the defendants could be convicted.

Jeremy Help, Christopher Ogier, Robin Help and Kevin Smith have all denied charges of abusing their position as refuse collectors, by dishonestly making private collections for business for cash-in-hand payments and then leaving St Peter Port parish to pick up the tip charges.

The defence advocates argued that their clients did not know what they were doing was dishonest and they all called for the case to be thrown out of the Magistrate's Court.

But Judge Philip Robey disputed their arguments, highlighting that the men were alleged to have been using States vehicles, with States fuel, while they were being paid by the States to do a different job, and then the parish was picking up the tipping bill.

The case continues.
