Truck driver found not guilty in cyclist's death

A TRUCK driver raised his right hand yesterday in a gesture of thanks to the Royal Court after he was cleared of causing the death of a cyclist by dangerous driving at Salerie Corner on 26 April last year.

Nigel Simon, 50, was also found not guilty on an alternative count of driving without due care and attention by a 6-3 majority.

The cyclist, Advocate David Allison, 59, died at the scene after he was run over by the lorry as it turned across the cycle path shortly after 8.30am.

Jurats took about 90 minutes to reach their decisions. The defendant's aquittal was unanimous on the first charge.

Mr Simon thanked the court after Judge The Right Hon. Sir Christopher Pitchers told him he was free to go.

During three days of evidence, the Royal Court heard from eight prosecution witnesses and one for the defence.

Summing the case up before the court adjourned, Sir Christopher told members of the court that if they were going to convict Mr Simon of dangerous driving they had to be sure that his actions that morning had fallen below the level of a competent and careful driver.
