Woman who sexually touched teen is jailed for three months

A woman who sexually touched a teenage boy in Market Square was jailed for three months when she appeared in the Magistrate’s Court.

Lina Frimate, 36, of Les Banques, St Peter Port, had denied the offence but was found guilty at trial in October.

The sentencing hearing was told how the incident happened in an early evening in May last year. The defendant, who had been drinking, approached the boy who was standing with his friends near the top of Market Steps. After a brief conversation with the group she partially exposed the top of her breasts before touching the boy on his crotch over his clothing.

In a victim impact statement that was read to the court, the boy said that since the incident he was reluctant to go out in case it happened again. He knew he had become snappy and more reactive to situations at school.

Defending, Advocate Samuel Steel said he was limited in what he could say as his client maintained her innocence.

This had been a single, brief, and impulsive act, fuelled by alcohol, in a public place. There had been no grooming and there was no evidence of her having an entrenched sexual interest in children.

She led a chaotic life and was insecure and vulnerable rather than predatory, he said.

Judge Gary Perry said the defendant had denied the offence in the face of what he had found to be overwhelming evidence against her. Her denial had forced the victim and one of his friends, plus another person, to have to give evidence in court.

She had little in the way of previous convictions but the court treated this sort of matter very seriously. Males who sexually touched women in nightclubs were regularly being sent to prison and this had involved a juvenile.

Frimate’s period of notification requirements was set at five years.

It was also alleged that she committed a similar offence on another occasion in St Peter Port which she had denied. That matter was dismissed when the prosecution offered no evidence.
