Woman who made racist comment to club door staff member is fined £750

DISORDERLY behaviour in Town led to a woman’s appearance in the Magistrate’s Court.

The court was told how monitoring of CCTV from the Joint Emergency Services Control Centre had alerted police to a woman who was behaving in an agitated manner at the North Plantation near the entrance to Folies nightclub.

Officers found her shouting and swearing at door staff and a man was trying to calm her down and move her away.

She was heard to shout ‘Wait till you finish work and I’ll kick your head in.’

As she walked away she made a racist comment towards one of the door staff and her shouting and swearing continued when she was arrested soon after near Red.

It was established that the intended recipient had not heard her racial slur.

King was convicted for an offence of disorderly behaviour in 2010.

Defending, Advocate Samuel Steel said his client did not seek to minimise her behaviour. She had been experiencing overwhelming grief and trauma at the time. Her alcohol intake had lowered her inhibitions and she had already been in an emotional state.

Judge Gary Perry said the letter the defendant had written to him was the same as anyone else who had been racially abusive. She said it was out of character and that she was not a racist.

‘When the first thing that comes out of your mouth is the reference to the colour of a person’s skin then you are a racist,’ he said. ‘Such words do not come from nowhere.’

This had been appalling and unacceptable behaviour and he fined her £750.
