Motorist found asleep in car after accident while more than twice the limit

A MOTORIST was more than twice the prescribed alcohol limit when he drove home after celebrating the birth of a friend’s baby.

Dennis Bernado, 36, of Les Oberlands, St Peter Port, admitted the drink-drive offence when he appeared in the Magistrate’s Court.

The court was told how the defendant’s vehicle had turned in to Beauville Apartments at 4.40am.

In doing so, his silver Daihatsu hit a building as it rounded a corner.

The car sustained extensive damage to its nearside and there was damage to the wall.

He then parked up and fell asleep in the vehicle.

At about 7am another resident was shown the damage to the wall.

When they followed a black scratch on the ground it led them to Bernado’s car, where he was still asleep.

Police were called and he was unsteady on his feet when asked to get out.

He failed a roadside breath test and an evidential one at the Police Station identified 82mcg of alcohol per 100ml of his breath. He made full admissions in interview and had no previous convictions.

Defending, Advocate Amy Davies said her client had been celebrating the birth of a friend’s son and had only driven a short distance.

He understood how dangerous his actions were.

Judge Gary Perry said that one of the advantages of being a judge in a small jurisdiction was that you could see increases in crime trends and there had been one in the number of drink-drivers he had had to deal with in the past few months.

As a result, the penalties had gone up. Bernado was fined £1,200 and banned from driving for three-and-a-half years.
