Man who attacked police officer gets suspended sentence

Ashley Ham, 30, admitted assaulting the police officer and an unknown male in Town when he appeared in the Magistrate’s Court.

The court was told that in the early hours of the morning at the Weighbridge Taxi Rank, CCTV captured the defendant pushing a man several times and then kicking him.

Police officers were quickly on the scene and people in the area directed them towards the defendant.

Ham initially interacted with officers before running off towards St Julian’s Avenue with one of the officers giving pursuit.

The officer took him to ground where he was forced to use Pava spray after the defendant had slapped him around the face before being restrained with the help of others.

The officer was also affected by the Pava spray and sustained minor scratches to his hands and arms.

In interview, Ham denied striking the officer or causing the scratches that he suffered. In 2014, while a juvenile in the UK, he was detained for three years for an offence of unlawful wounding.

Defending, Advocate Clare Carre said her client had been in Guernsey for work. He was very sorry for what he had done and the incident had happened on his first night out in the island.

He suffered PTSD as a result of the 2014 incident but he was not making excuses. He wanted to return to the UK.

Sending him to prison would mean he would lose his job and not be able to meet his mortgage payments.

Deputy Judge Graeme McKerrell said the 2014 sentence had been a significant one for someone so young.

Assaulting police officers was totally unacceptable and would be severely punished by the Guernsey courts.

Prison sentences of three months and two months were imposed consecutively for the assaults on the police officer and the unknown male respectively, suspended for 18 months.

Ham was also ordered to pay the officer £500 in compensation.
