Grandfather rights plan for settled guest workers

HOME AFFAIRS has now submitted its proposals to change the Population Management Law, which includes giving grandfather rights to those who are currently on a traditional nine-month licence with a three-month break in between.

The committee made its recommendation yesterday, just days after Economic Development submitted its argument for changes that include scrapping the new five-year cap on short-term workers who have one-year rolling licences.

Both come in response to serious recruitment problems in the hospitality sector.

While Home wants to go as far as grandfather rights, and scrap a five-year limit on residence in live-in open market staff accommodation for hotels and care homes, it has warned against making more drastic changes as the law, which came into force in April, has not had time to bed in.

‘Given the fluid nature of the situation, the committee is of the opinion that it would be unwise to make fundamental, far-reaching changes to the law at this time,’ it said in its States report.

‘Rather, it considers that some smaller changes have the potential to help employers through current difficulties while simultaneously providing breathing space to allow a more detailed review of the law and policies to be undertaken.’
