Six months in prison for headbutting another man in Town nightclub

Headbutting another male in a Town nightclub attracted a prison sentence for a 29-year-old man.

Eben Marsh, of Le Grand Bouet, St Peter Port, admitted a charge of assault when he appeared in the Magistrate’s Court.

The victim and his wife were sitting in a crowded area when the defendant stumbled towards them and spilled his drink over the woman.

When the woman told him to move away Marsh moved closer to her, as he said he could not hear what she said.

When the victim then asked what was being said, Marsh grabbed him with both hands and headbutted him, which caused him to fall backwards and hit his head on the bar.

Bouncers and the police became involved.

While being transported to custody Marsh told officers that he had been headbutted first so he had done the same to the other man.

The victim suffered facial injuries. Marsh had previous convictions for assault, the last of which was in 2020, and more recent matters were drug-related.

Defending, Advocate Samuel Steel said his client regretted his use of violence and wished to apologise to his victim.

His actions could not be justified. His upbringing had been tough and he was keen now to help others who had suffered in the same way.

Judge Gary Perry said the defendant had a poor record and he had breached court orders in the past. Positive signs were identified in the probation report but these were early days and he would get the chance to demonstrate this in the long term.

Whenever people used their head as a weapon they could expect to go to prison unless there were exceptional circumstances, of which there were none here.

Marsh was jailed for six months.
