Lorry driver fined £500 for sawdust spill in road

Bagged sawdust with a total weight of 1,000kg fell from the back of a lorry as it was driven around Salerie Corner.

The driver, Vincent Ballard, of Grandes Rocques, Castel, admitted using a motor vehicle with a load so secured that it caused a danger to others.

The Magistrate’s Court was told that a man who was adjusting his electric bicycle on the pavement at the time was unable to get out of the way and was struck by one of the bags.

He was covered in dust, and though unhurt, he was unable to get his bike to start again.

Mr Ballard told police that the load had shifted when he had been forced to brake by a vehicle that came out of Salerie car park, but CCTV footage did not back up his argument. He apologised for lying and said he was very ashamed at what he had done.

Defending, Advocate Mark Dunster said his client had resigned from his job with Channel Seaways a few days after, thereby demonstrating his remorse in the clearest possible way.

Judge Gary Perry said these were serious offences. Companies often shared responsibility with their employees in such cases, but the defendant appeared to have taken the brunt on his own on this occasion.

The court heard how Channel Seaways had been reported to the Health and Safety at Work executive following the incident.

Mr Ballard was fined £500.
