Man is jailed for spitting in the eye of a police officer

SPITTING in a police officer’s face was just one aspect of his crimes that made a sentence of youth detention inevitable for one defendant.

The Magistrate’s Court was told how Lewis Coutu, 20, had also told officers he would ‘rape their children’.

He admitted one count of assaulting a police officer and two of resisting officers in the due execution of their duties.

The court was told that in the first incident, police had been called to the Lower Pollet at 3am following reports of criminal damage being caused.

Coutu, who matched the description of the suspect they had been given, was arrested. He became hostile immediately and tried to pull away from them.

He had to be taken to the ground and continued to struggle even after being handcuffed. He made many attempts to head butt the inside of the police van when being conveyed to custody and a police officer suffered a wrist injury in the incident.

About a month later, officers were called to Les Douvres Hotel at St Martin’s, to deal with multiple incidents that required intervention.

They were told that the defendant had left the scene. Soon afterwards, a staff member said he had returned and Coutu was seen to jump from a balcony and try to escape. A struggle ensued during which he kicked the door of a police van closed to prevent officers putting him in it, and he spat in the eye of one of the officers.

His behaviour continued when taken into custody and he told officers he would rape their children if they had any.

In June this year he had been ordered to perform 90 hours of community service as a direct alternative to two months in custody for an assault in Town.

Defending, Advocate Candy Fletcher said her client did not dispute the facts of the three offences. He had expressed genuine remorse for actions on both of the nights in question and for the offensive language he had used towards police officers. He believed he suffered from PTSD from events that happened when he was younger and he had nowhere to live at the time of these incidents. He had completed 20 hours of the CSO and was asking for it to be continued.

Judge Marc Davies said that when it came to reasons he had to consider for sending the defendant to prison, Coutu had ticked all the boxes.

He had been determined to make the job of police officers as difficult as possible and had been volatile, threatening, and used the most revolting verbal abuse, which he had repeated.

Spitting in a police officer's face was about as disgusting a thing as you could do, he said, and all this came about because he did not like being told what to do.

He jailed him for one month for the incident in the Lower Pollet, plus three months consecutive for assaulting the police officer by spitting. One month, concurrent, was meted out for resisting police at Les Douvres. The CSO was revoked and replaced with a sentence of a further month in prison, which took the total penalty to five months’ youth detention.
